I WRITE further to your story about Timothy Howle and his benefits being stopped (Sentinel, May 15),

I am in a similar situation.

I have arthritis in my feet and I had to have the right one operated on in October last year. I am still recovering and it could take until October.

My Employment Support Allowance benefit was stopped in April because of this stupid 12-month rule. I have appealed against the decision but am still waiting for the result.

It's scandalous that genuine claimants are being tarred with the same brush as those that "bluff" it.

I wrote to my MP to make them aware of the situation. I might as well have written to Santa Claus.

If I had known that this 12-month rule existed, I would not have had surgery, collected the prescriptions, or reported my condition GPs.

This is the first time I have been on long-term sick, and after all those years of paying national insurance, I wonder if I'd be better off living on the moon.

We have outgoings that amount to more than what's coming in and I fear for the future. Adding to this, my condition is worsening and the DSS need further proof and that comes at a cost.

This country is on its knees and the Government doesn't have the bottle to help it up.

As with many other genuine cases and Mr Howle, I hope that you are all sorted soon.

    “Your appeal against the "stupid 12 month rule" wll be unsuccessful as it is now written into the law which applies to ESA. Your appeal will cost the taxpayer several thousand pounds to adminster but it is your right to appeal. You may even appeal against the appeal result and so and so on.

    You are not "tarred" with any brush. Your benefits are now means tested.

    You were sent a letter earlier this year to advise you that the goverment was intending to implement these changes to legislation but, as many people do, you either chose to ignore the letter or did not understand its content. If the latter is the case you should have contacted DWP to clarify the situation.

    You should have contacted your MP then not now. An MP cannot change the law once it is implemented. I think you will find your MP voted AGAINST the changes.

    Hopefully in future you and the many others who have been surprised by this widely reported (in the quality newspapers not the the Daily Mail, Sun Mirror etc) change to legislation, will ensure that you educate yourselves to the political changes that are taking place.

    Unfortunately I fear you will not as you like most people are only concerned about an issue when it affects them. You like many others insist that you are a genuine case and that the majority "bluff it". What crass ignorant nonsense.

    You did not venture to educate your self about political changes that would profoundly affect your life. But you see fit to make sweeping judgements about other people.

    This legislation, as are most of the amendments to benefits, aimed at those who have the least income. As I have posted previously, lobby your MP now to put a stop to futher changes. Not just those that affect you.”

In reality it simply means that the gov will save a few bob by chopping weekly payments down from 94 quid a week ESA to 67 quid JSA. A tidy sum if you think about it.
