TWO members of a gang which subjected a grieving son to a terrifying knife and gun attack after his own mother's wake have failed to persuade top judges their indefinite jail sentences were too harsh.

Tasab Hussain, aged 29, and Naim Mohammed Aziz, aged 28, were part of a 15 to 20-strong gang which waited for Damien Miller outside The Wedgwood pub, in Cobridge.

He was stabbed three times and a shotgun was also fired near him, on January 18, 2008.

Hussain, of Waterloo Road, Cobridge, and Aziz, of St Edward Street, Burton-upon-Trent, were both convicted of violent disorder and carrying a firearm with criminal intent, at Stoke-on-Trent Crown Court. They got indefinite terms of imprisonment (IPPs) for public protection on April 23 last year. Both were given four-and-a-half years before they could apply for parole.

Judges at London's Criminal Appeal Court heard both had appealed against the finding of dangerousness which led to the IPPs. Hussain said it was Aziz who had carried the gun, and both said that they should have been got definite release dates.

Lord Justice Hooper said the attack had been a "classic case of joint enterprise", and threw out both appeals.

    “i agree with them that the judge should have given them an ipp sentence.

    they carried out the actions, when confronted about the incident they didnt even have the courage to own up immidiatly about their involvement.

    THE JUDGE WAS WRONG IN THEIR SENTENCING.
    they should have been given a life sentence with no chance of release.
    i think thats a far more suitable sentence for them than a 41/2 year ipp sentence, at least they would know then that were not going to be released and also set a precidence for others that commit similar crimes involving firearms and knives that that type of behviour is not acceptable and will not be tolerated in our society.
    you cant deport them due to their nationality but you can give them a more suitable prison term..LIFE.”

    “Deport these guys now! Who cares that they were born and bred in Britain, are British citizens and have no other nationality, that's not the point. It doesn't matter that having no other nationality we have nowhere to deport them too. If they were called Carter, Cooper or Smith I'd expect them to be deported to Upper Saxony, Jutland or Frisia where their ancestors came from. It's irrelevent that they don't have German, Danish, or Dutch citizenship or that their families have been here for 70+ generations. The fact is that the ancestors in both cases emigrated here which means they are non-indigenous.”
