THE brother of a man found battered to death in a flat has escaped an immediate custodial sentence after breaching a suspended sentence order.

Andrew Townley, aged 34, of Penarth Grove, Hanley, received the original sentence for having a broken bottle in Percy Street, Hanley, on June 15. The order was made in September, but Townley failed to comply with the curfew.

North Staffordshire magistrates heard the defendant has suffered mental health problems since the death of brother Brian, whose body was found at Hempstalls Court, Newcastle, last summer. The suspended sentence order was extended to 18 months..

Thomas Heames, of Hempstalls Lane, Newcastle, and Richard Kelly, of Parkhead Drive, Weston Coyney, await trial accused of murdering Brian Townley.
